Please read these Terms of Service ("Terms") carefully before using the SAYVA mobile application ("App") operated by 17669186 Canada Inc. ("SAYVA", "we", "us", or "our").

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. If you are under the age of majority in your jurisdiction, you must have permission from a parent or legal guardian. By using the App, you represent that you meet these requirements.

2. Account Registration

To use certain features of the App, you must create an account using a valid phone number. You are responsible for maintaining the confidentiality of your account and for all activity that occurs under it. You agree to provide accurate information and to notify us immediately of any unauthorized use of your account.

You may delete your account at any time from the bottom of the Profile page within the App. You may also request account deletion by contacting us at admin@sayvagas.com. Upon deletion, your personal information will be removed in accordance with our Privacy Policy. All accumulated points will be forfeited upon account deletion.

3. Description of Service

SAYVA is a crowdsourced gas price tracking application. Users can submit photos of gas prices, view gas prices on an interactive map, earn and spend points, and receive price change notifications. The App is available in Canada and the United States.

4. User Content

By submitting photos, price information, or other content ("User Content") through the App, you:

• Grant SAYVA a worldwide, royalty-free, non-exclusive, perpetual license to use, display, reproduce, modify, and distribute your User Content in connection with operating and improving the App;
• Represent that you own or have the necessary rights to submit the content;
• Agree not to submit content that is false, misleading, illegal, offensive, or infringes on the rights of others.

We reserve the right to remove any User Content at our sole discretion without notice.

5. Points System

The App includes a points-based system. Points are earned through activities such as submitting gas prices, referrals, and watching advertisements. Points can be used to unlock features within the App, such as map access for a specified duration.

Points have no monetary value and cannot be exchanged for cash, transferred to other users, or redeemed outside of the App. We reserve the right to modify the points system, including earning rates and redemption values, at any time without prior notice. Points may expire or be forfeited if your account is terminated.

6. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose;
• Submit false, fabricated, or manipulated gas price information;
• Take photos at locations where photography is prohibited by posted signage, property rules, or applicable law;
• Attempt to exploit, hack, or reverse-engineer the App;
• Use automated tools, bots, or scripts to interact with the App;
• Interfere with or disrupt the App or its servers;
• Create multiple accounts to abuse the points system or referral program;
• Impersonate another person or entity.

Violation of these rules may result in suspension or permanent termination of your account, including forfeiture of all accumulated points.

7. Photography & Submission Conduct

The App allows you to submit photos of publicly displayed gas prices. When taking photos for submission, you acknowledge and agree that:

• You are solely responsible for your conduct while on gas station premises or any other private property;
• You must comply with all posted signage, property rules, and instructions from property owners or staff — including any "No Photography" policies;
• If asked by property staff to stop photographing or to leave the premises, you must comply immediately;
• You should only photograph publicly displayed price information (signs, pump displays) and must not photograph security equipment, payment terminals, PIN pads, or other sensitive infrastructure;
• You take photos voluntarily and at your own risk. SAYVA does not direct, require, or instruct you to photograph at any specific location;
• You must never use the App while operating a motor vehicle. Always park safely and come to a complete stop before using your phone to take photos or interact with the App. Distracted driving is illegal and dangerous. SAYVA is not responsible for any accidents, injuries, fines, or other consequences arising from use of the App while driving.

SAYVA is not responsible for any disputes, claims, injuries, or legal consequences arising from your photography or conduct at gas stations or any other premises. Any interaction between you and a property owner or their staff is solely between you and them.

8. Accuracy of Information

Gas prices displayed in the App are submitted by users and are not verified by SAYVA. We do not guarantee the accuracy, completeness, or timeliness of any gas price information. Prices may be outdated, incorrect, or unavailable. You should always confirm prices at the gas station before making purchasing decisions. SAYVA is not responsible for any decisions made based on information provided through the App.

9. Intellectual Property

The App, including its design, code, graphics, logos, and trademarks, is the property of 17669186 Canada Inc. and is protected by Canadian and international intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the App without our prior written consent.

10. Third-Party Services

The App may integrate with or rely on third-party services (such as map providers, payment processors, or advertising networks). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the availability, accuracy, or conduct of any third-party services.

11. Privacy

Your use of the App is also governed by our Privacy Policy. By using the App, you consent to the collection and use of your information as described therein, including location data used to provide map and station proximity features.

12. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, secure, or free of viruses or other harmful components.

13. Limitation of Liability

To the maximum extent permitted by applicable law, SAYVA, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of or inability to use the App, regardless of the theory of liability.

In no event shall our total liability to you exceed the amount you have paid to us, if any, in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify and hold harmless SAYVA, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the App, your User Content, or your violation of these Terms.

15. Termination

We may suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App ceases immediately. All accumulated points will be forfeited upon termination. Sections of these Terms that by their nature should survive termination shall remain in effect.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the App or by other reasonable means. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any disputes arising from these Terms or the App shall be subject to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada.

18. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

19. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and SAYVA regarding the use of the App and supersede any prior agreements.
